Husband and wife accused of assaulting school resource aide at Volusia County middle school

VOLUSIA COUNTY, Fla. – A husband and wife were arrested Tuesday after law enforcement said they assaulted a school resource assistant at Deltona Middle School Tuesday morning.

Jorge Rivera, 46, and his wife, Dagmarie Aponte Iturrino, 45, came to school Monday to protest their son’s battery charge for pushing a girl at school, according to a press release.

Lawmakers said Rivera became angry when he didn’t like the outcome of the meeting and began yelling at the lawmaker and was asked to leave.

When Iturrino entered the hallway, he pushed the deputy against the wall, according to the statement. Rivera then punched the deputy in the head, knocking him to the ground and knocking the Taser out of his hand.

The deputy then stood up, drew his firearm, and ordered Rivera to drop the stun gun before taking him into custody.

Rivera and Iturrino face charges of battery on a law enforcement officer, resisting with violence, disrupting school operations and trespassing on a school campus.

Rivera also faces armed robbery and grand larceny charges for taking the deputy’s Taser, deputies said.

In addition, a hate crime enhancement was added to some of Rivera’s charges due to the derogatory insult he said to the lawmaker before attacking Rivera.

Deputies said the couple’s son witnessed the entire incident.

The deputy was treated at the scene and at an area hospital for concussion symptoms.

“If you’re wondering why some kids in today’s society don’t fear consequences, look no further than these parents in Exhibit A,” Chitwood said. “I am glad they are incarcerated and look forward to seeing them held fully accountable for this blatant attack on our deputy who was just doing his job.”

The deputy was treated at the scene and at an area hospital for concussion symptoms, according to the statement.

Iturrino is being held on $11,000 bond, while Rivera is being held without bond.
