Trump’s trial in New York on hold as prosecutors investigate impact of presidential victory • Ohio Capital Journal

WASHINGTON — All court proceedings related to President-elect Donald Trump’s criminal conviction in New York are now on pause while the prosecution reviews the case against the man who will be sworn in as the 47th president of the United States.

New York Judge Juan Merchan on Monday postponed all proceedings in People of New York v. Donald J. Trump until Nov. 19, according to email correspondence between all parties. It was published by the court.

US special advisor Jack Smith similarly requested Federal judge will postpone hearings on Trump’s 2020 election interference lawsuit.

Trump, who was found guilty of 34 counts of business fraud by a jury in late May, is scheduled to be sentenced on November 26.

Merchan has not yet ruled on Trump’s request to dismiss the case, which has triggered questions about what evidence against a former president may or may not be admissible in court, based on the U.S. Supreme Court’s presidential immunity ruling in July.

sought delay

Merchan agreed to the postponement in response to a joint application from both the New York District Attorney’s Office and Trump’s defense team asking for the case to be dismissed outright.

New York prosecutor Matthew Colangelo said in an email to Merchan on Sunday that Trump’s team had asked the state on Friday to delay the case; “To provide time to review and evaluate a range of arguments based on the impact of the presidential election results on this process.”

Colangelo said the “unprecedented circumstances” presented by Trump’s election victory are “the next steps in this process, including (1) a jury finding guilty after a trial with a presumption of regularity; and (2) the Office of the President.”

Colangelo asked Merchan to give him until November 19 to decide how and whether the investigation will proceed.

Later Sunday morning, Trump attorney Emil Bove sent Merchan an email acknowledging the prosecution’s request for a deadline.

“Remaining in office and impeachment are necessary to prevent unconstitutional impediments to President Trump’s ability to govern, which is the broader argument we presented to DANY on Friday,” Bove wrote.

34 serious crimes

Trump made history on May 30 as the first former president to be convicted when a New York jury found him guilty of all 34 felony charges for concealing hush money payments to adult film actress Stormy Daniels ahead of the 2016 presidential election.
