It was reported that one person’s arm was broken when the door closed on them.

Automatic sliding doors are one of those modern conveniences designed to make family life smoother, especially when your hands are full or your kids are coming in and out. So what happens when this feature goes from convenience to a potential security hazard? That’s the issue at the center of a new class-action lawsuit in the US alleging the sliding doors will be closed in 2022 and 2023. Kia Carnival poses a “serious risk of bodily injury” and puts passengers in danger.

The lawsuit, filed in the U.S. District Court for the District of Maryland, alleges that these Carnival models are equipped with a defective pinch sensor along the rubber seal on the edge of the doors. In theory, these sensors are supposed to detect any obstacles in the door’s path and prevent the door from closing if something (or someone) is in the way.

Kia issues recall for reportedly defective doors But the class action lawsuit claims that this recall is “ineffective” because it is a simple software update that causes the door to close more slowly and also adds warning chimes. Plaintiffs claim this does not affect the force required to trigger the pinch sensor.

The recall included 51,568 people Carnivals from model years 2022 and 2023 Delivered in the United States. At the time, Kia said it had received 9 reports of injuries related to the faulty pinch sensor; One of them was a person’s thumb being broken, the other was someone’s arm being broken after the door closed.

The lawsuit argues that many customers would not have purchased the Carnival or would have paid much less for the minivan if they had known about the defect. Plaintiffs accuse Kia of breach of both express and implied warranty, as well as allegations of fraud, unjust enrichment, and violation of the Maryland Consumer Protection Act.

They are now pushing for a jury trial and full recovery of damages, interest and legal fees. What started as a minor software recall for Kia could turn into a costly courtroom showdown if this class action lawsuit gains momentum.
