The unnamed victim was attacked by a cherry picker while collecting supplies in Sittingbourne.

A few minutes later he was dragged under the truck, the driver making no effort to slow down.

Four seconds later, the forklift operator appeared to realize what had happened and turned the vehicle around to rescue the man.

The employee’s leg was broken in several places and his ankle was dislocated.

His injuries were so severe that he had to have a metal plate inserted into his left leg.

Following the crash in July 2023, a Health and Safety Executive (HSE) investigation was launched.

At Maidstone Magistrates’ Court on November 14 the business pleaded guilty to breaching section 2(1) of the Health and Safety at Work Act 1974.

The company was fined £400,000 and ordered to pay £5,567 in costs.

HSE inspector Peter Bruce said: “Poor vehicle and pedestrian separation at work is a common cause of fatal incidents and injuries.

“In this incident, the employee suffered multiple fractures and required a metal plate inserted into his leg, which he would wear for the rest of his life.

“Employers need to ensure they take appropriate measures to separate pedestrians and vehicles.

“This includes providing safe systems of work, appropriate training procedures and systems to ensure compliance with these measures.

“If employees are found not to be complying with these measures, employers should consider the reasons behind implementing additional risk-appropriate measures.”
