“Pretrial incarceration does not impact an individual’s right to vote,” a BOP representative told The Post on Tuesday. “This means that if the individual had the right to vote before entering the custody of the Federal Bureau of Prisons (FBOP), his right to vote does not change unless he is convicted.”

“Incarcerated individuals who are in pre-trial status or ‘not convicted of a crime’ have the right to vote but must use the absentee voting system,” the representative added.

Like all voters, MDC inmates must register to vote before they can request an absentee ballot. But there are a few additional hurdles to receiving and returning ballots from behind bars.
