SAN JOSE, California. – embattled San José Councilman Omar Torres was arrested Tuesday, according to his attorney and authorities.

Torres’ attorney, Nelson McElmurry, also told KTVU that his client submitted a resignation letter from his office earlier today, and coincidentally the arrest occurred a few hours later.

San Jose Mercury News reports a slightly different set of events, reporting that the District 3 councilman was arrested on suspicion of child molestation hours after submitting his resignation.

San Jose Police Department also confirmed Torres’ arrest, saying it was solely related to “an ongoing investigation into lewd acts towards a child.” The police department said they would release more information at a press conference on Wednesday.

Calls for Torres’ resignation have increased in recent weeks after it was revealed that he was under investigation by the SJPD for sexual crimes against children. Local residents started a petition to recall Torres as many in the community say he has had enough and is no longer fit to serve. However, the recall process can take months and require signatures.
