Mother charged with vehicular homicide and DUI after 3-month-old son dies after fiery crash

LOUISVILLE, Ky. (WAVE/Gray News) – A baby who was seriously injured in an early morning crash in Louisville has died, and the mother is facing multiple charges in her death.

According to the Louisville Metro Police Department, officers were called to a collision at Newburg Road and East Indian Road just before 5:40 a.m. Thursday.

Authorities said the Dodge Dart caught fire after rear-ending a Ford Escape.

Arriving officers reported finding a woman holding a child outside the Dodge while the vehicle was on fire.

Police said the woman, later identified as 18-year-old Lyillie Pena, suffered minor injuries, but the child, a 3-month-old infant, suffered serious injuries.

First responders took the child to Norton Children’s Hospital, but he died around 8:45 a.m.

The man driving the Ford told cops he saw a car “coming towards him” as he braked at a red light. The crash resulted in his SUV crashing into the median of the grass.

The male driver told police that Pena was the aggressor while the two were talking after the crash. He also said he had bright eyes and breath that smelled of alcohol while appearing unsteady on his feet.

According to police, Pena told officers he drank 99 proof alcohol and took Adderall the night before around 10 p.m.

Pena was arrested and faces charges including vehicular homicide, aggravated DUI and criminal mischief. He was booked into the Louisville Metro Jail.

During the booking process, police obtained a search warrant to take blood from Pena. The arrest report stated that a blood alcohol test returned a reading of 0.039.

Pena is scheduled to appear in court Friday.

The child’s name has not been released at this time by the Jefferson County Coroner’s Office.
