A 32-year-old man was arrested Tuesday for evading police while driving under the influence, according to police.

Brett Hutton, of West Decatur, appeared before Magisterial District Judge Tracy Powell Thursday morning and was charged with evading arrest, driving under the influence, driving on a suspended license, careless driving and several other related charges.

According to the Probable Cause Affidavit, around 1:30 p.m. on Nov. 5, a Pennsylvania State Police officer observed Hutton driving eastbound on U.S. 22 near mile marker 209 with a DUI suspended license.

Officer “he passed the vehicle and used the PennDOT photo to verify that Hutton was the operator.” Before activating emergency equipment to stop traffic.

Hutton initially did not respond to the emergency lights and continued driving, eventually heading onto the shoulder of the highway. “I never stopped completely.” before re-entering the travel lanes and accelerating.

The officer initiated a pursuit in which Hutton traveled at various speeds up to 100 miles per hour. “The overlapped lane indicators did not use turn signals and did not respond to emergency equipment.”

The pursuit lasted approximately five miles and crossed into Perry County before the vehicle turned right and crashed into a guardrail near mile marker 214.

Hutton then fled from police on foot along the Juniata River and attempted to hide himself in a wooded area, where he was captured and taken into custody.

After Hutton was taken into custody, the arresting police officer “Smelled like alcoholic beverages” In the person of Hutton he said: “His (Hutton) eyes looked glassy and bloodshot.”

Hutton admitted to consuming alcohol and was transferred to Penn State Health Holy Spirit Medical Center, where he refused a legal blood draw.

Officers then contacted Center County Probation and issued a detention order to Hutton. After being released from the hospital, Hutton was booked into the Perry County Jail.

On Wednesday, police obtained a search warrant for Hutton’s medical records; When records were accessed, it was determined that Hutton was driving with a positive presence of alcohol and THC in his system.

Hutton is currently being held in the Mifflin County Jail unable to post bail, which is set at $50,000, awaiting a preliminary hearing scheduled for Nov. 27.
