Florida man sentenced to prison for parole violation

A Deltona man was charged in February beating your dog with a chain at the gas station The person, who was later sentenced to house arrest, was sent to prison on Thursday on the grounds that he violated probation.

Jose M. Rivera, 31, was charged in February with three counts of battery, resisting arrest without violence, child abuse and aggravated animal cruelty. He was sentenced to community control/probation in September.

He admitted to the judge Thursday that he violated probation and was sentenced to 16 months in prison.

Volusia County sheriff’s deputies were called to a gas station at 2798 Elkcam Boulevard on Feb. 1 at 5:08 p.m. In Deltona, bystanders intervened to stop Rivera, who was “brutally beating his dog with a chain,” according to an arrest report.

The report stated that nine witnesses, including a 13-year-old boy, intervened to stop Rivera in a fight that broke out after a witness rescued the dog and put the animal in his car.

Deputies said a witness told Rivera to leave the dog alone, and he walked up to the witness and punched him in the face.

The report stated that after Rivera and the witness fought, the 13-year-old boy tried to stop the fight, but Rivera attacked the boy who was grazing him.

While Rivera was fighting with the witnesses, the dog ran up to another witness, who caught the animal and put it in his truck. Rivera tried to grab the dog from the witness’ truck, but another man forced Rivera to choke him to stop him.

The dog was delivered to Rivera’s girlfriend.

On Tuesday, Rivera was arrested for violating house arrest/parole on two separate occasions in October.

On Oct. 5, the parole officer was alerted twice by the GPS monitor that Rivera was not home as required by community control conditions. Rivera said he was looking for work and his probation officer told him his trip was not approved.

Later on October 26, the GPS monitor showed Rivera leaving his home three times and walking approximately 16 houses in different directions from his home and then returning. These trips were also not approved by his parole officer on Rivera’s weekly itinerary.
