On Tuesday, U.S. District Judge Arun Subramanian ordered the Manhattan U.S. Attorney’s Office to delete photos of a 19-page notebook obtained during a raid on Combs’ jail cell last month. Prosecutors are also barred from using the material at Combs’ bond hearing Friday.

Facing charges of racketeering conspiracy, sex trafficking and transportation for the purpose of prostitution, the music mogul pleaded not guilty. It also faces several civil lawsuits filed in recent months.

The notebook, labeled “what to do,” reportedly contained notes about paying off potential witnesses and uncovering damaging information about two alleged victims. Prosecutors argued that this evidence could support additional charges of obstruction of justice against the artist.

Combs’ legal team calls Fed behavior ‘outrageous’

Prosecutor Mary Slavik defended the seizure, saying, “The government obtained these materials through entirely appropriate channels.” He argued that Combs’ notes, which included plans to target witnesses as well as unidentified “inspirational quotes,” fell outside attorney-client privilege protection.

But Combs’ legal team strongly opposed the government’s actions as “outrageous.” Marc Agnifilo, one of Combs’ attorneys, accused federal officials of overreaching. “This was a complete institutional failure,” Agnifilo said, arguing that the raid and seizure violated attorney-client privilege.

Judge Subramanian ordered the notebook to be kept safe for now while he deliberates whether prosecutors could use it to build an obstruction case.

Combs, 55, was arrested in September and has been held in the Brooklyn Metropolitan Detention Center since then. His legal team repeatedly requested that he be released on bail, offering $50 million as a condition. The next bail hearing is scheduled for Friday.
