Applebee’s sues franchisee who closed 8 locations in Kansas City area

KANSAS CITY, Mo. — Applebee’s files lawsuit against owner of recently shuttered franchise eight Kansas City area locations.

  • 3404 Rainbow Boulevard, Kansas City, Kansas
  • 2912 South Fourth Street, Leavenworth, Kansas
  • 16110 West 135th Street, Olathe, Kansas
  • 6800 Johnson Drive, Mission, Kansas
  • 1700 Village West Parkway, Kansas City, Kansas
  • 1501 Northeast Douglas Street, Lee Summit, Missouri

In the lawsuit, Applebee’s alleged that the franchisee violated its contract with the restaurant by unilaterally closing the restaurants without the franchisor’s permission.
The closure also violated the franchise agreement; because the move took place before the contract expired.

The agreement required the franchisee to pay Applebee’s for royalties and advertising fees.

Applebee’s is seeking $4,476,000 in future damages.

Additionally, the closures meant the franchisee violated leases for the Raytown, Mission, Leavenworth and Olathe restaurant properties.

Applebee’s Restaurants Kansas, LLC, where the franchisee assumes all lease obligations, is responsible for approximately $3,600.00.

In addition to royalties/advertising losses and unpaid rent, Applebee’s is also seeking reimbursement for attorneys’ fees and litigation costs.

Applebee’s is therefore seeking approximately $8,076,000 in total damages.

The hearing of the case, filed in the US District Court for the District of Kansas, will be held in Kansas City, Kansas.
