Horry County day care refils lawsuit months after former employee pleaded guilty to child harm

MYRTLE BEACH, S.C. (WMBF) – A Horry County day care is once again facing a lawsuit, months after a former employee pleaded guilty to harming children in her care.

Records show a lawsuit for negligence was filed against My Sunshine Child Development Center on Monday, and the lawsuit seeks actual, consequential and punitive damages.

His It’s the second lawsuit filed against the daycare since August.

Monday’s lawsuit was filed by a woman who claimed her five-year-old niece, for whom she is also the legal guardian, was in day care and was harmed by former teacher Alexandria Allabaugh.

The lawsuit alleges that My Sunshine found the allegations involving Allabaugh on Feb. 14 and called a meeting of parents two days later to inform them that he had been fired.

The lawsuit alleges that the parents were shown images of Allabaugh abusing several children, including the woman’s niece, “waking the children up from their sleep by kicking them, knocking them off their sleeping mats, yelling at the children excessively, and grabbing and dragging the children by force.” .”

A man identified as the child’s other legal guardian was at the meeting, and the lawsuit alleges the man was unable to finish the entire video because he was so uncomfortable. The child was later removed from day care and “suffered injuries and harm resulting from mental anguish, emotional distress, and physical injury” as a result of what happened, the lawsuit states.

Similar to the lawsuit in August, Monday’s lawsuit alleges that Allabaugh is under investigation by the South Carolina Department of Social Services in 2022 for allegations at a different day care.

The investigation found these allegations to be “unfounded,” but Allabaugh was terminated anyway.

Allabaugh was arrested in March and sentenced to probation after pleading guilty to three counts of third-degree assault in July.
