Republican pollster Frank Luntz warned about the impact former President Trump’s victory in the 2024 presidential election would have on the U.S. Supreme Court.

“The Supreme Court is still not a sure thing with the Senate going red and Trump being very likely to be elected at this point, but if he’s elected he gets the appointment and when the Senate is Republican, whoever he wants goes,” Luntz said during an appearance on NewsNation on Tuesday night.

“This is the biggest impact you can make this election night because there are probably several judges who will retire in the next year or two,” he added, without specifying which judges might retire soon.

Luntz’s remarks came before Decision Desk Headquarters (DDHQ) named Pennsylvania a battleground state for Trump, resulting in the choice itself for the Republican candidate early Wednesday.

Trump appointed three justices during his first term in the White House: Justices Brett Kavanaugh, Neil Gorsuch and Amy Coney Barrett. With the addition of Roe to the bench. v. The Wade case was overturned in 2022, ending the federal right to abortion and returning the right to the states.

The pollster argued that it would be easier for Trump to implement some of his policy proposals once he has a majority in the Senate.

“If he has the Senate, it becomes easier for him to put forward economic policies, and some of them don’t even need the vote of Congress, but if you’re looking for that, that tariff policy is more likely than not to happen. “Get in the game,” Luntz said.
