WASHINGTON (AP) — Supreme Court allows national drug therapy and anti-doping rules Horse racing is expected to remain in effect while the court fight, which is likely to end with the judges, continues.

On Monday, the court put on hold a decision by the 5th U.S. Circuit Court of Appeals that Congress gave too much power to the Horse Racing Integrity and Safety Authority, the private agency that administers the rules.

Other appeals courts have rejected similar challenges, and justices are likely to step in to resolve conflicting decisions.

In addition to Texas, racetracks in the state and neighboring Louisiana also defied the emergency call.

The anti-doping program, which takes effect in spring 2023, is an attempt to centralize drug testing of racehorses and manage the results and impose uniform penalties on horses and trainers instead of the previous patch rules across 38 racing states.

The authority’s lawyers told the court that the program had led to a 50% drop in horse deaths at participating racetracks. Meanwhile, death rates in other regions have also increased, they wrote in their legal filing.

Legislation to eliminate new authority It was introduced to the House of Representatives but went nowhere.
