Robert Roberson update: Texas Supreme Court rules against lawmakers who halted execution with last-minute subpoena

The Texas Supreme Court on Friday ruled that a legislative subpoena cannot be used to stop the execution after Republican and Democratic lawmakers used a new maneuver to pause the lethal injection of Robert Roberson at the last minute last month.

Roberson was scheduled to die by lethal injection on October 17, when lawmakers, as a last resort, issued a subpoena for him to testify at the Texas Capitol, just days after his planned execution.

This triggered a legal dilemma between the state’s criminal and civil courts, ultimately leading the Texas Supreme Court to temporarily rule in Roberson’s favor.

Roberson, who was sentenced to death for killing his 2-year-old daughter in 2003, received bipartisan support from lawmakers and medical experts who said he was convicted because of faulty evidence regarding the “shaken baby” diagnosis. If executed, Roberson would be the first person in the United States to die from shaken baby syndrome.
