A young woman who pepper-sprayed a Muslim Uber driver on the Upper East Side over the summer has been charged with a hate crime in the attack, the Manhattan District Attorney’s Office said.

Jennifer Guilbeault, 23, was indicted in New York State Supreme Court on two counts of assault as a hate crime and aggravated harassment for the unprovoked attack near Lexington Avenue and East 66th Street on July 31. Manhattan DA Alvin Bragg said in a statement.

“Jennifer Guilbeault senselessly attacked a Muslim Uber driver while he was doing his job,” Bragg said. “The victim is a hard-working New Yorker who should not have to face this kind of hatred because of who he is.”

Driver Shohel Mahmud, later He claimed that Guilbeault initiated the attack just because of his skin color.

“Her friend screams, ‘Jen, Jen, what’s going on, what are you doing? What’s going on?’” Mahmoud told The Post days after the attack. “His friend said, ‘Why did you do this?’ he asks. And he said, ‘Brown.'”

According to the video circulating on various social media sites, Guilbeault suddenly sprayed the harmful substance into the 45-year-old driver’s eyes while he and the other woman were sitting in the backseat around 12:15 p.m.

Mahmud said he didn’t talk to them when he picked them up in Midtown.

“They talk to each other,” he said. “I don’t talk to them, my job is to direct them. From the Central Park Traverse, I start heading straight towards 65th and Lexington. “All of a sudden, this girl sprayed me with pepper spray for no reason.”

Bragg said Guilbeault ambushed his driver, who began praying in Arabic as he approached a red light.

Mahmud jumped out of the car; He thought the women were trying to rob him and his vehicle.

But the car crawled along without him, so he jumped back in and Guilbeault sprayed him again.

“I just want to say this is completely ridiculous,” added the father of three, who lives in Elmhurst, Queens. “I’m not doing anything and he sprays me. Pepper spray is illegal. He attacked the driver for no reason. “This is a hate crime.”

Cops arrested Guilbeault at the scene but initially only gave him a desk ticket.

His lawyer said the incident should not be charged as a hate crime.

“Woman. In his statement, Michael J. Alber stated that Guilbeault’s motivation was not due to race, religion, national origin or any other discriminatory factor.

“This case needs to be considered with all the circumstances, including the consideration of all the evidence and the lack of evidence,” he added. “We look forward to working with the District Attorney’s Office to fully review all facts in an appropriate forum that does not embellish or exaggerate the allegations, especially where the integrity and credibility of the allegations can be appropriately tested.

The next hearing date is January 13.
